Call it a logo, a brand, a product name, a company name or a tagline — a registered trademark is one of the strongest tools you have for identifying your business and defending your commercial rights.

A trademark is a distinctive sign, with or without a graphic form. It's what separates one company's products and services from everyone else's. It doesn't describe what the product is made of or how the service works — it tells people who stands behind it.

Registering a trademark gives the owner exclusive rights over the name and/or the graphic form, for the products and services covered by the registration, plus the right to stop anyone else from using it without permission.

Depending on what they're made of, individual trademarks fall into a few types:

• ○ WORD MARKS (letters and/or numbers only, with no special typography and no logo);


• ○ COMBINED MARKS, BLACK AND WHITE or COLOUR (letters and/or numbers set in a distinctive typeface, or paired with a figurative element — a logo);


• ○ FIGURATIVE MARKS, BLACK AND WHITE or COLOUR (a logo on its own, with no letters or numbers);


• ○ THREE-DIMENSIONAL MARKS (the shape of the product or its packaging, shown in three dimensions).

Registration is filed with OSIM, Romania's state office for inventions and trademarks, and it's tied to what your business actually does: you register for specific products and services, under the Nice Classification in force on the day you file.
